After David Stewart
his staff (according to his own saying) had painted the first coat on
the walls and ceilings, David John Stewart
agreed to have the final coat on everything on
the right side of the corridor at
7-9 New street, Kilmarnock painted by a painter.
The painter
proceeded with the works. David actually explained that his
staff painted the first two coats and that the painter had to do the
final coat:
what turned out to be the final two coats, as they supplied the
cheapest Leyland paint at £12,00 for 10L.
During a telephone conversation preceding the start of the work, David
remarked to the painter that he could write in the contracts:
"Everything on the right side of the corridor."
This turned out to be a trap, as later, when the painting was done, he added facings, doors, hinges etc.
and claimed that the painter also had to paint them as they were at the right side of the corridor.
After completion of the works, the painter messaged and invoiced David John Stewart.
Days later,
awaiting payment, the following conversation takes place.
DAVID
JOHN STEWART, DIRECTOR OF RUBBERSEAL LIMITED. KILMARNOCK
Notice
how he does not respond to my last question?
After this David tried to blackmail the painter to do more work for him,
to get his £250,00. He claimed that the work was not finished.
If now the painter would do his reception area and some added items in the offices, he would pay him a total of £300,00!
But why wait moths for that argument, after I have filed a suit?
Would he not have said this before he paid the
£500,00. And why the Quote: "And will let acciounts know."
Months later he had not yet found anyone to do the job for him?
How on earth???
